Frederick Hyde Limited respects your privacy and is committed to protecting your personal data. This privacy notice will inform you as to how we look after your personal data once you start the job application process and tell you about your privacy rights and how the law protects you.  This personal information may be held by the organisation on paper or in electronic format.

This privacy notice applies to all job applicants, whether they apply for a role directly or indirectly through an employment agency. It is non-contractual.

This privacy notice aims to give you information on how Frederick Hyde Limited collects and processes your personal data through our recruitment process.

It is important that you read this privacy notice together with any other privacy notice or fair processing notice we may provide on specific occasions when we are collecting or processing personal data about you so that you are fully aware of how and why we are using your data. This privacy notice supplements the other notices and is not intended to override them.

How we collect your data

How data is collected

We may collect this information in a variety of ways. For example, data might be contained in application forms, CVs, obtained from your passport or other identity documents, or collected through interviews or other forms of assessment. We may also collect personal data about you from third parties, such as references supplied by former employers.

Data from third parties

We will seek information from third parties only once a job has been offered to you and you accept.

If you fail to provide personal data

If you fail to provide certain personal information when requested, we may not be able to process your job application properly or at all, we may not be able to enter into a contract with you, or we may be prevented from complying with our legal obligations. You may also be unable to exercise your statutory rights.

 

The data we collect about you

Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

We may collect, use, store and transfer different kinds of personal data about you which we have grouped together as follows:

  • Identity Data [first name, maiden name, last name, date of birth, gender and information about your entitlement to work in the UK].
  • Contact Data [home address, email address and telephone numbers].
  • Personal Data [details of your qualifications, skills, experience and employment history, including start and end dates with previous employers].
  • Medical Data [whether or not you have a disability or health condition for which the organisation needs to make a reasonable adjustment during the recruitment process].

Data will be stored in a range of different places, including interview paperwork, our human resources management system and other IT systems (including our email system).

 

How we use your data

We need to process data prior to and when entering into an employment contract with you.

We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:

  • Where we need to comply with a legal or regulatory obligation.
  • To check a candidate's eligibility to work in the UK before employment starts.
  • Where we need to do so to take steps at your request prior to entering into a contract with you, or to enter into a contract with you.

We have a legitimate interest in processing personal data during the recruitment process and for keeping records of the process. Processing data for job applicants allows us to manage the recruitment process, assess and confirm a candidate's suitability for employment and decide to who to offer a job. 

We may also need to process data from job applicants to respond to and defend against legal claims.

We will not use your data for any purpose other than the recruitment exercise for which you have applied. 

 

Change of purpose

Keeping data for future roles

We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If your job application is unsuccessful, the organisation may wish to keep your personal information on file in case there are future suitable employment opportunities with us.

Withdrawing consent

We will ask for your consent before we keep your personal information on file for this purpose. Your consent can be withdrawn at any time.

 

Sharing your data

Internal access

Your information may be shared internally for the purposes of the recruitment exercise. This includes members of the human resources team, interviewers involved in the recruitment process.

Third parties

We share your data with third parties in order to obtain pre-employment references from other employers.

If your application is successful, we will share your data with the companies engaged by us to process data on its behalf such as payroll and pension providers; the provision of benefits and the provision of occupational health services.

 

Data security

Security measures

We take the security of your personal data seriously. All appropriate technical and organisational measures are taken to ensure security of storage of and access to your data.

Third party obligations

Where we have engaged the services of third parties to provide services on their behalf and on behalf of employees, it does so on the basis of a comprehensive service supply contract which obliges them to comply fully with the data protection legislation including information security.

 

Data retention

Unsuccessful applicants

If your application for employment is unsuccessful, we will hold your data on file for 12 months after the end of the relevant recruitment process. At the end of that period, your data is deleted or destroyed.

Successful applicants

If your application for employment is successful, personal data gathered during the recruitment process will be transferred to your electronic case file and retained during your employment. The periods for which your data will be held will be provided to you in a new privacy notice at the point at which you are offered employment with us.
